A Minnesota prosecutor charged a US immigration officer with two counts of second-degree assault after he pointed his duty weapon at two motorists, in what officials described as the first state criminal charge against a federal agent stemming from Operation Metro Surge.

The Immigration and Customs Enforcement agent drew his firearm and aimed it at people in an adjacent vehicle as he was driving in an unmarked rental vehicle illegally on a highway shoulder on Feb. 5, said Hennepin County Attorney Mary Moriarty. According to an interview with Minnesota investigators, Morgan acknowledged drawing his weapon after the other vehicle had returned to the legal travel lane.
