The European Union’s top court should invalidate a decision by the bloc’s executive to release more than €10 billion ($11.9 billion) in funds over Hungary’s judicial reforms, according to the court’s adviser.

The European Commission was wrong in December 2023 to unlock the EU funds, after it found that Hungary had satisfied its conditions on shoring up judicial independence, Advocate General Tamara Ćapeta said in an opinion on Thursday. While such opinions are non-binding, they usually set the tone for final rulings that follow several months later.
